By accessing or using Kai Fitness Platform (“the Service”), operated by MENTOR AGORA LTD, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
These Terms of Service constitute a legally binding agreement between you and MENTOR AGORA LTD (Company Number: 16692440), operating as Kai Fitness Platform.
Permission is granted to use the Service for your business purposes. This is the grant of a license, not a transfer of title, and under this license you may not:
Subscriptions are billed on a monthly basis. You may cancel your subscription at any time. Refunds are provided according to our refund policy.
Kai uses Stripe Connect to process payments on behalf of studios. When your members purchase memberships, class packs, or other services through the platform, the payment is processed by Stripe and paid out directly to your connected Stripe account.
MENTOR AGORA LTD is not a party to the transaction between you and your members. You are responsible for the services you provide and any refund obligations to your members. By using the platform, you agree to Stripe's Connected Account Agreement.
You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.
By using the Service, you acknowledge that we collect usage analytics to improve the platform. We use PostHog to gather anonymised data about how the platform is used, including page views, feature usage, and interaction patterns.
Analytics data collection on public pages requires your consent via our cookie consent banner. For registered users, analytics data is collected under our legitimate interest in improving the Service, as described in our Privacy Policy.
You may opt out of analytics tracking at any time through your cookie preferences. Opting out will not affect your ability to use the Service.

Our platform integrates with Meta's WhatsApp Business API to enable messaging between you and your members. By using our WhatsApp messaging features, you agree to comply with:
Message Consent Requirements:
You must obtain explicit consent from recipients before sending WhatsApp messages. Recipients must have opted in to receive messages from you. You are responsible for:
Opt-Out Rights:
Recipients may opt-out of receiving WhatsApp messages at any time by replying “STOP” to any message or by contacting you directly. You must honor all opt-out requests immediately and remove opted-out contacts from your messaging lists.

Violation of these terms may result in suspension or termination of your WhatsApp messaging capabilities and your account.
In no event shall Kai Fitness Platform, MENTOR AGORA LTD, or its suppliers be liable for any damages arising out of the use or inability to use the Service.
We are not responsible for the delivery, content, or availability of messages sent through the WhatsApp Business API. Message delivery is subject to Meta's infrastructure and policies. We are not liable for any issues arising from Meta's services, including but not limited to message delivery failures, service interruptions, or changes to WhatsApp's policies or features.
